TERMS AND CONDITIONS FOR TRAININGS AND ON-LINE COURSES

The following constitute the terms and conditions to which applicants agree when booking any standard GOODMAN GROUP Sp. z o. o. face-to-face public class training or online learning courses (“Terms & Conditions”).

1. BOOKING:

1.1 Standard training:

Standard Face-to-face public class training and online learning courses can be booked via the booking forms available on the GOODMAN GROUP Sp. z o. o.   websites. On submission of the face-to-face and public class training course or online learning course form you will receive an automated summary email of your selection. GOODMAN GROUP Sp. z o. o. will accept your offer by entering your booking onto the GOODMAN GROUP Sp. z o. o. system and sending you an email confirming that you have been booked together with informations on starting your learning. Training and course purchases are valid only for the specific date and time specified in your booking.

1.2 Custom Trainings and Services:

Custom trainings and services engagements can also be contracted through GOODMAN GROUP Sp. z o. o. Services in the form of a GOODMAN GROUP Sp. z o. o. Customer Agreement.

1.3 On-line Trainings and Services:

We will provide you with access to online training course materials after we have confirmed your order by email and you have paid the course fee.

2. PAYMENT:

Training and course fees can be paid by bank account transfer or we can send you a PayPal payment link to PayPal secure online payment process, by credit card (Mastercard, Visa, and American Express)  In all cases, payment must be received prior to start of training.
A receipt will be sent to you by email. GOODMAN GROUP Sp. z o. o.
All payments are due in USD at the time of purchase. Sales taxes (VAT, TVA etc.), if any, are charged at the applicable rate depending on the product and/or customer.

3. YOUR RESPONSIBILITIES:

You may not allow anyone else to access the online training courses via your log-in details. You must comply with all safety rules and regulations and any other reasonable security requirements that apply at the premises at which the training courses are provided.
GOODMAN GROUP Sp. z o. o. reserves the right to remove any delegate from a training course whose behaviour is deemed inappropriate by GOODMAN GROUP Sp. z o. o. or its trainers. In these circumstances, GOODMAN GROUP Sp. z o. o. will neither refund any fees nor reimburse any other costs.

4. YOUR INFORMATON:

You agree that the information that you provide to us on registration and at all other times will be true, accurate, current and complete and you agree that you will ensure it is kept accurate and up to date at all times. We may refuse to accept your application to register as a user for any reason in our absolute discretion.

5. WARRANTY AND DISCLAIMER:

GOODMAN GROUP Sp. z o. o. ensures that all our training services are delivered diligently and in a good, workmanlike, timely and professional manner consistent with industry standards. The training services will be performed as described in the individual class agendas.
GOODMAN GROUP Sp. z o. o. shall provide such trainers to present the training course as it, in its sole discretion, deems fit and GOODMAN GROUP Sp. z o. o. shall be entitled at any time to substitute any trainer with any other person who,in GOODMAN GROUP Sp. z o. o. sole discretion, it deems suitably qualified to present the relevant course.
GOODMAN GROUP Sp. z o. o. does not warrant that the provision of any content online will always be available or be uninterrupted, timely or error free, that defects will be corrected or that such content is secure or free from bugs, viruses, errors and omissions.
The training courses and training materials are provided „as is“. There are no warranties, express or implied, by operation of law or otherwise for the use or results of the course and materials, that you will successfully complete the course, or that any particular level of knowledge will be attained by you (the results are also dependent on you).
GOODMAN GROUP Sp. z o. o. disclaims any implied warranties including the implied warranties of merchantability and fitness for a particular purpose.

6. INTELLECTUAL PROPERTY:

6.1. All Intellectual Property Rights in the Course Materials, Online Courses and the speeches made by trainers at the Taught Courses are, and remain, the intellectual property of GOODMAN GROUP Sp. z o. o. or its licensors, whether adapted, written for or customised for the Client or not.

6.2. You are not authorised to:

    • copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without prior written permission;
    • record on video or audio tape, relay by videophone or other means the Online Course or Taught Course given;
    • use the Course Materials in the provision of any other course or training whether given by us or any third party trainer;
    • remove any copyright or other notice of GOODMAN GROUP Sp. z o. on the Course Materials;
    • modify, adapt, merge, translate, disassemble, decompile, reverse engineer (save to the extent permitted by law) any software forming part of the Online Courses.

Breach by you of this clause 5.2 shall allow us to immediately terminate these terms and conditions with you and cease to provide you with any Services, including but not limited to access to the Online Courses.

6.3. In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive licence to use the Course Materials and the software in respect of the Online Course for the sole purpose of completing the Online Course and / or attending the Taught Course.

7. CONFIDENTIALITY:

7.1. Each party shall keep the other party’s Confidential Information strictly confidential and not use it otherwise than for the purposes of these terms and conditions, and shall return it on demand and not retain copies of it.

7.2. Either party may disclose Confidential Information to its legal and other advisors for the purposes of obtaining advice from them.

7.3. This clause shall continue notwithstanding termination of these terms and conditions.

8. THIRD PARTY LINKS:

The Training Websites may provide links to third-party websites from time to time. We are not responsible in any way for the content of any third party website or for goods or services provided by the operators of such websites.

9. CANCELLATION:

9.1. Cancellation by customer:

9.1.1 Face to Face Public Class:

Notice of a training registrant’s intent to cancel a registration must be made by emailing office@goodman.eu and is subject to the following terms:

    • Training registrants whose cancellation request is received in excess of 21  days prior to the start date of the training activity will incur an administration fee equal to 30% of the obligatory fee.
    • Training registrants whose cancellation request is received within 20  to 14  days prior to the start date of the training activity will incur an administration fee equal to 50% of the obligatory fee.
    • Training registrants whose cancellation request is received within 13  days prior to the start date or after the commencement of the training activity will incur an administration fee equal to 100% of the obligatory fee.

9.1.2 Online Learning:

Notice of a training registrant’s intent to cancel a registration must be made by emailing office@goodman.eu and is subject to the following terms:

    • Training registrants whose cancellation request is received in excess of 21  days prior to the start date of the training activity will incur an administration fee equal to 30% of the obligatory fee.
    • Training registrants whose cancellation request is received within 20  to 14  days prior to the start date of the training activity will incur an administration fee equal to 60% of the obligatory fee.
    • Training registrants whose cancellation request is received within 13  days prior to the start date or after the commencement of the training activity will incur an administration fee equal to 100%  of the obligatory fee.

9.2. Cancellation by GOODMAN GROUP Sp. z o.o.:

GOODMAN GROUP Sp. z o. o. reserves the right to cancel courses, change online platform, change instructors, or change course content. In the event that a course must be canceled registrants will be informed at least 7  days prior to the start of the course. Registrants will be notified via email GOODMAN GROUP Sp. z o. o. will make every effort to avoid cancellations. In case of a cancellation registrants will receive a refund for the full course fee.

10. MISCELLANEOUS:

There will be no replacement classes or extra materials for participatns, students who missed a lesson.

11. JURISTICION:

These Terms are governed by and shall be construed in accordance with Polish law. Any dispute arising between us and you under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the English courts.

12. AMENDENTS TO THE TERMS:

We reserve the right to amend these Terms from time to time. When we make a change we will update this page.

13. FORCE MAJEURE:

GOODMAN GROUP Sp. z o. o. shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, epidemic, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the trainer’s family, illness of the trainer, Government edict or regulation.

14. PRIVACY POLICY:

All information provided by you under these Terms & Conditions will be treated in accordance with GOODMAN GROUP Sp. z o. o. Privacy Policy.
